1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the language instruction, tutoring, training, workshops, and related services offered by Maple Bridge German Learning Inc. ("Maple Bridge German Learning Inc.", "we", "us", or "our"). By accessing, booking, enrolling in, or using our services, website, online platforms, materials, or communications, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services. If you are enrolling a minor, you represent and warrant that you are the parent or legal guardian and that you agree to these Terms on the minor’s behalf.
2. Scope of Services
Maple Bridge German Learning Inc. provides German-language education and related services, which may include, without limitation:
- Private German lessons;
- Small group conversational classes;
- Corporate German training;
- Online German tutoring;
- Test preparation for Goethe and TELC exams;
- German grammar workshops; and
- Kids and teen German programs.
We may deliver services in person, online, or through a hybrid format. We reserve the right to modify class formats, schedules, instructors, platforms, curricula, and service offerings at our discretion, subject to applicable law and any specific written agreement with you.
Any descriptions of services, course outlines, or promotional materials are provided for general information only and do not constitute a guarantee of outcomes, test scores, fluency levels, academic admission, employment, immigration, or any other result.
3. User Obligations and Responsibilities
By using our services, you agree to:
- Provide accurate, current, and complete information when registering, booking, or communicating with us;
- Promptly update your information if it changes;
- Attend sessions on time and prepared;
- Use our services only for lawful purposes and in accordance with these Terms;
- Respect instructors, staff, other students, and our property, systems, and materials;
- Not record, reproduce, distribute, publish, or share classes, lessons, or materials without our prior written consent;
- Ensure that your equipment, internet access, and software are adequate for online services where applicable;
- Supervise minors in relation to enrollment and participation, where applicable; and
- Comply with any additional policies, rules, or guidelines communicated by us from time to time.
You must not use our services to harass, disrupt, abuse, threaten, or otherwise interfere with instruction or with the rights of others. We may suspend or terminate access for misconduct, repeated lateness, non-payment, inappropriate behaviour, or violation of these Terms.
4. Payment Terms and Conditions
Fees for services will be communicated at the time of booking, enrollment, invoice issuance, or in a separate written agreement. Unless otherwise stated, all fees are payable in Canadian dollars (CAD) and are subject to applicable taxes, including GST/HST/PST where applicable.
- Payment may be required in advance for lessons, packages, classes, workshops, exam preparation, or corporate training.
- We may require a deposit, registration fee, or full prepayment to secure a booking or enrollment.
- Invoices are due by the date specified on the invoice or booking confirmation.
- Late or failed payments may result in suspension of services, cancellation of enrollment, or collection efforts, as permitted by law.
- Any applicable bank charges, currency conversion fees, chargeback fees, or payment processor fees are your responsibility unless prohibited by law or otherwise agreed in writing.
Prices may change from time to time. Changes will not affect services already paid for unless otherwise agreed or required by law. Promotional pricing, discounts, and package terms may be subject to eligibility requirements and expiry dates.
5. Cancellation and Refund Policy
Our cancellation and refund policies may vary depending on the type of service, instructor availability, program structure, and whether the service is delivered in person or online. Unless a separate written policy or agreement applies, the following general rules apply:
- Private lessons: Cancellations or rescheduling requests should be made at least 24 hours before the scheduled lesson. Missed sessions or late cancellations may be charged in full.
- Group classes and workshops: Seats are limited. Cancellations after the program start date or within a stated cancellation window may not be refundable.
- Corporate training: Cancellations and changes are subject to the terms of the applicable service agreement or invoice. Custom curriculum development and reserved instructor time may be non-refundable.
- Online services: Services delivered online are subject to the same cancellation rules, except where technical issues are caused by our systems; in such cases, we will make reasonable efforts to reschedule or provide a remedy.
- Kids and teen programs: Parent or guardian consent is required. Refunds and withdrawals may be subject to administrative fees and program deadlines.
Refunds, if approved, will be made using the original payment method where reasonably possible and may be reduced by any non-recoverable costs, administrative fees, or services already delivered, to the extent permitted by law.
We reserve the right to cancel, postpone, or reschedule any class or service due to insufficient enrollment, instructor unavailability, safety concerns, force majeure, or other reasonable operational reasons. In such cases, we will offer a rescheduling option, credit, or refund as appropriate and required by law.
Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws in Canada, including any rights relating to services not provided as agreed.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Bridge German Learning Inc., its directors, officers, employees, contractors, agents, and instructors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunities, or anticipated savings arising out of or in connection with your use of our services.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services will not exceed the amount paid by you for the specific service giving rise to the claim during the three (3) months immediately preceding the event giving rise to liability, unless otherwise required by law.
We do not guarantee uninterrupted or error-free service, specific learning outcomes, exam success, or third-party platform availability. We are not responsible for issues caused by your internet connection, device, software, third-party service providers, or failure to follow instructions.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, wilful misconduct, fraud, or other liability that cannot lawfully be excluded.
7. Intellectual Property Rights
All teaching materials, lesson plans, presentations, worksheets, videos, audio recordings, assessments, course content, trademarks, logos, and other intellectual property provided by Maple Bridge German Learning Inc. are owned by us or our licensors and are protected by applicable intellectual property laws.
Subject to your compliance with these Terms and any applicable payment obligations, we grant you a limited, non-exclusive, non-transferable, revocable license to use materials solely for your personal, non-commercial educational purposes or, in the case of corporate clients, for internal training purposes as agreed in writing.
You may not copy, reproduce, distribute, sell, sublicense, modify, publicly display, record, translate, create derivative works from, or otherwise exploit our materials without our prior written consent. Any feedback, suggestions, or ideas you provide to us may be used by us without obligation to you, subject to applicable law.
8. Data Protection and Privacy
We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including, where applicable, the Personal Information Protection and Electronic Documents Act (PIPEDA) and relevant provincial privacy legislation.
Personal information may be used for purposes including:
- Registration and account administration;
- Scheduling, billing, and payment processing;
- Delivering lessons, assessments, and communications;
- Customer support and service improvement;
- Maintaining records required by law; and
- Marketing communications, where permitted by law and subject to your consent where required.
We may use third-party service providers to support payment processing, scheduling, online instruction, analytics, or communications. These providers may process information outside of your province or outside Canada. By using our services, you acknowledge that your information may be transferred to and processed in other jurisdictions, subject to applicable safeguards and legal requirements.

9. Force Majeure
We will not be liable for any delay, interruption, rescheduling, or failure to perform our obligations to the extent caused by events beyond our reasonable control, including but not limited to natural disasters, fires, floods, storms, epidemics, pandemics, public health emergencies, war, terrorism, civil unrest, labour disputes, governmental actions, power outages, telecommunications failures, internet outages, or failures of third-party platforms or suppliers.
In such circumstances, we may suspend, modify, or reschedule services and will use reasonable efforts to restore services as soon as practicable.
10. Changes to Terms
We may update or modify these Terms from time to time to reflect changes in our services, operations, legal requirements, or business practices. The updated Terms will be effective when posted on our website or otherwise communicated to you, unless a later effective date is stated.
Your continued use of our services after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the services.
11. Applicable Law and Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or relating to them, the services, or your use of the services will be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that the courts located in British Columbia, Canada, will have exclusive jurisdiction over any dispute arising from or relating to these Terms or our services, except where applicable law requires otherwise.

13. Severability Clause
If any provision of these Terms is held to be invalid, illegal, unenforceable, or contrary to applicable law by a court or competent authority, that provision will be severed or limited to the minimum extent necessary so that the remaining provisions will continue in full force and effect to the fullest extent permitted by law.
Any failure by us to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
